On 3/31/10 at approximately 1358 hours Gilroy Police Department officers responded to 9400 No Name Uno Dr. (Saint Louis Hospital) on a report of a male masturbating in public.
After a thorough investigation police learned that Guzman is a taxi driver for Union Cab Company in Gilroy. Guzman was called to Saint Louis Hospital to pick up a fare for a ride to an unknown location. When Guzman arrived to pick up the fare, hospital staff told him that he was no longer needed and could leave.
Guzman went into the public restroom. After leaving the public restroom Guzman begins to exit the hospital and notices a young girl sitting alone in the emergency room waiting area. Guzman walked into the room and sits down near the 10 year old female victim and immediately began to rub his genital area over his pants.
A hospital employee told Guzman the child did not need a ride and that he could leave. Guzman walked back into the waiting area and again sat down near the victim. Guzman then exposed his penis and began to masturbate. The victim got up and walked out of the room. Guzman immediately followed the victim. An alert hospital employee was able to distract Guzman and kept him occupied until security arrived and detained Guzman.
After the Police arrived Guzman made several incriminating statements and was ultimately arrested and booked on the above misdemeanor charges. Guzman was transported to the Santa Clara County Jail.
According to the owner of Union Taxi, Guzman had only been working at the business for 5 days prior to the incident. The owner did not require Guzman to go to the Police Department and apply for a taxi permit as is standard practice.
